Sheria ya Afya ya Jamii 2009 na Afya ya Wafanyakazi – Takwimu, Gharama, na Haki za Binadamu

Katika mijadala ya sera za afya na kazi nchini Tanzania, kuna jambo muhimu ambalo mara nyingi halizingatiwi vya kutosha: mahitaji ya upimaji wa afya kwa wafanyakazi, gharama zinazobebwa na waajiri, na athari kwa wafanyakazi wenyewe na biashara ndogo.

Sheria ya Afya ya Jamii ya mwaka 2009 (Public Health Act, 2009) inatambua umuhimu wa ufuatiliaji wa afya ya wafanyakazi ili kulinda afya ya umma. Sehemu ya sheria hii inaelekeza kwamba wafanyakazi wanaofanya kazi katika mazingira ya hatari wanapaswa kupimwa afya mara kwa mara, mara nyingi kutafsiriwa kama kila miezi sita. Hata hivyo, sheria haifafanui ni aina gani ya vipimo vya kiafya vinavyohitajika, wala haibainishi ni magonjwa ya kuambukiza au yasiyo ya kuambukiza yanayopaswa kutambuliwa.

Katika utekelezaji wa vitendo, baadhi ya halmashauri zimeendelea na kanuni ndogo ambazo zinatoa taratibu za upimaji, na hata kupanua gharama kwa waajiri. Kwa mfano, Manispaa ya Ubungo imeweka ada ya TZS 5,000 kwa kila mfanyakazi kwa kila kipindi cha upimaji, ambayo inapaswa kulipwa na mwajiri. Hata hivyo, maeneo mengine gharama zinaweza kutofautiana kulingana na kanuni za halmashauri husika. Kwa biashara ndogo na kati ambazo tayari zinakabiliwa na changamoto za kifedha, gharama kama hizi zinaweza kuzidisha mzigo wa udhibiti bila ushahidi wa hatari halisi.

Magonjwa ya Kazini na Hatari Halisi
Takwimu za afya kazini nchini Tanzania zinaonyesha kwamba wafanyakazi wanakabiliwa na hatari halisi za kiafya: mabaki ya utafiti ya afya ya wafanyakazi wa uzalishaji chuma yameonyesha kuwa 65.1 % ya wafanyakazi waliopimwa katika sekta hiyo walipata angalau jeraha moja la kazi katika mwaka mmoja, na urefu wa masaa ya kazi ulikuwa kiashiria cha hatari kubwa zaidi.

Katika sekta ya afya, tafiti zinaonyesha kuwa zaidi ya 78 % ya wauguzi katika Moshi Municipal walikumbana na hatari za kiafya mahususi ikiwemo jeraha kutokana na sindano (20 %) na mfiduo wa damu na mkojo (56.7 %), na karibu nusu ya waliokaguliwa walipata hatari hizo miaka moja iliyopita.

Kwa magonjwa ya kuambukiza, nchi bado ina mzigo mkubwa wa TB, ambaye kiwango cha tukio kiliripotiwa kuwa 183 kesi kwa kila 100,000 watu mwaka 2023—hali inayoweka hatari halisi kwa wafanyakazi wenye kazi zinazohusiana na mzunguko wa maambukizi.

Mifano hii inadhihirisha wazi kuwa kuna mkusanyiko wa hatari kazini—za magonjwa ya kuambukiza na zisizo ya kuambukiza—na hivyo kuna mantiki ya sera dhabiti ya afya kazini. Hata hivyo, itakuwa haieleweki kutangaza kanuni ya upimaji bila kipimo maalum, data ya hatari, na tafsiri ya kitabibu.

Gharama ya Upimaji na Utekelezaji
Katika mazingira ya biashara ndogo na kati, gharama za upimaji mara nyingi hulipwa na mwajiri kama sehemu ya matakwa ya manispaa au taasisi za afya. Hata hivyo, kutoeleweka kwa sheria kuu kunaacha nafasi kwa utekelezaji usio sawa na gharama zinazoweza kuzidisha mzigo wa uendeshaji, bila kubainisha ni vipimo gani vinavyolengwa.

Hii ina maana kwamba biashara zinazoanza au zinazokua zinaweza kukumbana na mzigo usio wa lazima wa gharama, na hii inaweza kuathiri ajira, tija, na uthabiti wa soko.

Haki za Mfanyakazi na Maadili ya Upimaji wa Afya
Maandishi ya sera ya kimataifa kama ILO Convention on Occupational Health Services (C161) yanasisitiza kuwa upimaji wa afya kazini unapaswa kufanywa kwa ridhaa ya mfanyakazi, haipaswi kusababisha hasara ya kipato, na matokeo ya vipimo hayawezi kutumiwa kumdhalilisha au kumfukuza kazi mtu bila msingi imara wa kitabibu. Utaratibu huu ndio unaochangia uhifadhi wa heshima, usiri, na haki za mfanyakazi wakati huo huo ukilinda afya ya umma.

Katika mazingira ya Tanzania, ambapo mfuko wa bima za afya unaenea chini (chini ya 8 % ya watu wote), walio wengi hufanya malipo ya moja kwa moja kwa huduma za afya, na hivyo gharama kama upimaji wa mara kwa mara kwa mfanyakazi zinaweza kuwa chanzo cha mzigo wa kifedha kwa wafanyakazi wenye kipato cha chini.

Mwisho wa Sera Yetu
Tunahitaji sera ya afya kazini ambayo inazingatia takwimu halisi za hatari, ikawa na ufafanuzi wa vipimo vinavyohitajika, inabainisha malipo na nani anayefadhili, na inalinda haki na utu wa mfanyakazi. Sheria ngumu bila mwanga wa data haiwezi kutimiza lengo la kulinda afya bila kuumiza uchumi wa biashara ndogo na kati.

Afya bora kazini ni muhimu kwa uzalishaji, ustawi wa familia, na ukuaji wa uchumi wa taifa. Sera zetu za kazi na afya lazima zithibitishe kuwa tunalinda afya ya wafanyakazi bila kuwatenga kiuchumi au kumuingiza mfanyakazi katika hali ya hatari zisizo za lazima.
