Terms of References for Carrying out Consultancy work on developing a Policy Paper on “Property rights to women in Tanzania” by reviewing recent Reports such as the “Economic freedom index and Property rights Index”

  1. BACKGROUND AND RATIONALE

Liberty Sparks is an Educational and RESEARCH, Free Market based THINK TANK with a mission to IMPROVE and PROMOTE individual understanding of ECONOMIC, social, and political LIBERTY.

ARDHI YANGU, MAISHA YANGU is one of its core programs of Liberty Sparks that focus on researching and recommending policy reforms on “Women's Property Rights in Tanzania” known as “Ardhi Yangu, Maisha Yangu Campaign(My Land, My Life)”. It is a single-year project that is being implemented in Tanzania, funded by the ATLAS NETWORK. It aims at improving Women's Land Rights in Tanzania. FRASER INSTITUTE  and other publication cited in 2022's ECONOMIC FREEDOM report and PROPERTY RIGHTS report indicates that the latest annual ratings prove slope back changes in Property Ownership in Tanzania as ranked 72 in 2020 compared to 71 in 2019 among the 190 economies.[1] The project focuses only on the Property Rights of women while focusing on; Administrative Requirements, Procedures, Prohibitive Costs, and Time (Cost and Procedure for Women filing cases on land matters, Community tribunal supporting women, and cultural and traditional barriers). The project aims the provision a policy paper to be presented to decision and policymakers to incorporate the recommendations on policy formulation processes that will be contributing to improving property ownership for women in Tanzania.

 

The Liberty Sparks is looking for an Informed Policy Analyst and Consultant to carry out a Consultancy Service on review of international and local literature/reports such as the international property rights index, Economic freedom index and to identify gaps and recommend policy reforms for Women Land Ownership in Tanzania

OBJECTIVES

  1. To review different papers on “Property Rights to women in Tanzania 2023” in accordance with identified gaps.
  2. Recommend the Property Rights for women policy reforms to be incorporated in Policy Formulation Processes in Tanzania
  • To produce a high-level policy paper to be presented to policymakers
  1. SCOPE OF WORK

The consultant will conduct but not be limited to the following activities;

  1. Review and understand the nature and focus of the Liberty Spark on improving Property Rights in Tanzania's “Property Rights for Women” reforms.
  2. Conduct round tables and interviews with high-level informants and decision-makers
  • Draw a schedule/work plan for the consultancy work
  1. Conduct inception meeting with Liberty Sparks’ project team/ focal person(s) to agree on the mode, contents, and quality of the work
  2. Submit the draft paper and present the findings
  3. Submit the final paper and present it to stakeholders.
  4. CONSULTANT’S PROFILE

The contracted Consultant should be an Individual or registered entity in Tanzania, pays taxes, and have a minimum experience of at least 5 to 10 years in Policy work and research in Tanzania.  Should have qualified experts to carry out policy review, strong facilitation, and influential figure, analytical and report writing skills in order to carry out responsibilities and credible report.

  1. TIMELINE

The consultancy work should start as soon as a consultant will be awarded this bid, 14 days from the date of approval and signing of the contract. Not more than three months are dedicated to this review and policy paper submission.

  1. MANAGEMENT OF THE CONSULTANCY

This consultancy will be fully managed by Liberty Sparks Tanzania through its directorate of Research and Education. The consultant will bear all administrative, management, and direct costs related to the activities that will be carried out and to be presented in the budget proposal.

  1. COMMUNICATION

All communications related to activities should be channeled to the Director of Research and Education at Liberty Sparks.

  1. BID PROPOSAL AND SUBMISSION DETAILS

The bid proposal should cover the following:

  • An inception report with a detailed work plan.
  • One page of Consultants’ understanding of the ToRs.
  • Two pages of the proposed methodology, activities, and expected outcomes;
  • A detailed activities schedule/work plan with a time frame
  • Financial proposal including Itemized consultant’s fees, and administration expenses; Validity period of quotation; Expected mode and payment plan.
  • A profile of the consulting firm or individual including the full names, physical addresses, telephone numbers, and contact person of the firm/company; date of registration, registration number, copy of registration certificate and VAT certificate; names of directors/proprietors;
  • Copy of CVs of all the consultants who will undertake activities
  • Submission is to be done via email address. (Only softcopy is recommended)
  1. DEADLINE FOR SUBMISSION

Technical and financial Proposals are to be submitted in a soft copy via [email protected] on 15 May 2023 before 16:00hrs.

Only the top three shortlisted Consultants will be asked to submit their hard copy proposals to the Director of Research Office located at Kunduchi, Mtongani P.O.Box 6662 Dar es Salaam - Tanzania.

  1. ASSESSMENT FRAMEWORK FOR THE SELECTION OF THE COMPANY/ORGANISATION OR THE INSTITUTE

Consultants will be selected on the basis of how well they can fulfil the requirements of the Terms of Reference and an assessment. 

  1. BINDINGS

All documents, papers, and data produced during the assessment will be Liberty Sparks’ property and restricted for public use with ought prior permission. The contracted agency/consultant will submit all original documents, materials, and data to the Director of Research at our office.

  1. DISCLAIMER

Liberty Sparks reserves the right to accept or reject any or all proposals without assigning any reason whatsoever.

  1. CONTRACTUAL RELATIONSHIP

Activities will be led by the consultant, in a close relationship with Liberty Sparks. 

  1. ETHICAL CONSIDERATIONS

The activities agreed upon in this consultancy should be carried out in a very professional manner with respect to the Policy Agenda

  1. LIBERTY SPARKS’ PROTECTION POLICY AND CODE OF CONDUCT

The consultant undertaking the activity must demonstrate commitment to strictly adhering to the Protection Policy and Code of Conduct. It is the responsibility of Liberty Sparks to ensure that all persons hired, used, or otherwise consulted for this exercise, are made familiar with the policies and are in agreement to also abide by them before their services are agreed to. Any violation /deviation in complying with the policy will result in the termination of the agreement.
